As reported in the media today, Council issued an infringement notice to a vehicle parked in a No Standing Zone on Park Road, Cheltenham in December 2017.

The driver appealed to Council however the infringement was not withdrawn. Council officers investigated the appeal grounds with Public Transport Victoria and found the driver had not left sufficient time to remove her car from the No Standing Zone, regardless of the delay caused by the cancellation of train services on the day.

Under the Infringement Act 2006, there are five grounds for appealing an infringement notice. A driver who has appealed to Council for a review of a fine and is not satisfied with the outcome can elect to have the matter dealt with by the Magistrate’s Court. In this case, the driver pleaded guilty at the Moorabbin Magistrate’s Court.
