Yarra Ranges Council is reminding residents and purchasers of Cloverlea Estate in Chirnside Park that its properties are developed and sold with a number of conditions, which may restrict future development and building works.
The restrictions include a designated building envelope for any building or works, including garages, decks, retaining walls and outbuildings.
Buildings and works outside of the designated building envelope are not permitted.
These restrictions by the developer are reflected on the title of the property and Council does not have any ability to vary or omit these restrictions.
Properties in the estate are also affected by a Memorandum of Common Provisions provided by the developer, which specifies design guidelines, including setbacks, finishes and materials to be adhered to.
For example, garage setbacks are required to be 5.5 metres from a property’s front boundary.
Council is unable to vary or omit these set requirements, either.
Yarra Ranges Council strongly encourages residents and purchasers to carefully review all information on their property.
It is important for owners and purchasers to be aware of the restrictions imposed by the title and any Memorandum of Common Provisions provided by the estate’s developer.
