Barunga West Council has now formally resolved to increase the expiation fee for breaches of Council By-Laws and Permits from $55 to $85. This expiation fee amount has not changed since the installation of the current boat ramp ticket machines in 2005. This expiation fee applies to such things as using the boat ramps and wood collection without a valid permit or ticket. Section 246(5) of the Local Government Act 1999 provides Council with the power to fix an expiation fee for alleged offences against by-laws, provided that the expiation fee does not exceed 25 per cent of the maximum fine for the offence to which it relates. Currently, the maximum fine for a breach of a Council By-Law is set at $750. Therefore, the maximum expiation fee that Council can set is $187.50. Barunga West Council encourages all ratepayers, residents and visitors to be mindful of Council By-Laws and Permits, and the potential expiation fee that may be applied if these By-Laws or Permits are breached.
