Local law amendments

Redland City Council has amended a local law regulating fishing from bridges and culverts, and implemented a new local law regulating the placement of shipping containers and railway carriages on land.

Mayor Karen Williams said the amendments and new local law followed community consultation from 23 May to 29 June 2018.

“Local laws play an important role in Council’s day-to-day operations by helping to regulate a vast range of activities across Redlands Coast,” she said.

The changes to the local laws are as follows:

New Subordinate Local Law

Subordinate Local Law No. 1.19 (Placement of Shipping Containers, Railway Carriages and other Objects on Land) simplifies and clarifies the provisions for the approval and placement of shipping containers and other objects that may not be considered buildings or structures under the Building Act 1975.

It describes:

–     the circumstances where a permit is not required, typically for when a shipping container is placed for a temporary purpose

–     the circumstances where a permit is required or where the placement of certain objects is prohibited

–     the process for a permit to place certain shipping containers, railway carriages and other objects on land

–     the conditions that will be imposed on an approval

–     the term of an approval and renewal

–     design and siting provisions based on the zoning of a property

Subordinate Local Law No. 1.19 (Placement of Shipping Containers, Railway Carriages and other Objects on Land) applies to zones nominated as residential, environmental/rural and open space and sub categories of each.  The subordinate local law is effective from 4 February 2019.

Council also agreed to consider further amendments to the local law as it pertains to the environmental and rural zones; in particular, the prescribed criteria for placement of a shipping container, railway carriage, or other object on land.

Amended Local Laws

Local Law No. 1 (Administration) 2015 was amended to facilitate the new Subordinate Local Law No. 1.19 (Placement of Shipping Containers, Railway Carriages and other Objects on Land).

Subordinate Local Law No. 4 (Local Government Controlled Areas, Facilities and Roads) 2015 was amended to allow fishing from a local government bridge or culvert unless otherwise signed.
