An inspection was made at the site in early 2017. 

It was determined the works had been to stabilise a wall in a dam which had pre-dated the Ballarat Planning Scheme. 

Under the Ballarat Planning Scheme, works of this type do not trigger a planning permit. 

A planning permit would be required to build a new dam that would change the rate of flow across a property boundary. 

Direction would need to be sought from the Glenelg Hopkins Catchment Management Authority before deciding an application on the basis of today’s Planning Scheme.
