In November 2018, Cardinia Shire Council received a planning application for an eight-storey mixed-use development for 48-50 James Street, Pakenham.
The proposed height did not adequately respond to the character of James Street and Council was working with the applicant to reduce the height. During these discussions, the applicant lodged an appeal to VCAT.
The application was advertised by VCAT, with only one objection received.
At a recent VCAT Compulsory Conference hearing, Council successfully negotiated a reduction in building height of two storeys, from eight to six storeys.
Council officers negotiated strongly for the height reduction, after submitting the Council’s intended refusal of the application at eight storeys.
The proposal now reflects the preferred height for the future Pakenham Activity Centre Zone, which seeks increased densities within this area.
The new design features six storeys, with the two uppermost storeys being appropriately recessed.
The applicant has also confirmed the development will comply with the number of car parking spaces required under the Cardinia Planning Scheme.
A number of permit conditions will be imposed to strengthen the development’s adherence to achieving good town planning and design outcomes.
