Have your say on Council's draft Contaminated Land Policy

Bega Valley Shire Council is seeking community feedback on its draft Contaminated Land Policy.

“Council has an obligation to manage contaminated land in accordance with legislative requirements in NSW,” Council’s Director of Community, Environment and Planning, Alice Howe said.

“This draft policy aims to provide a framework for Council to appropriately manage land contamination through the land use planning process.

“It will also guide Council’s due diligence disclosure of information on contamination via section 10.7 planning certificates.”

The draft Contaminated Land Policy sets out how Council will:

identify, evaluate and manage contaminated land through the land use planning process record, manage and disclose contaminated land information report contamination to the NSW Environment Protection Authority prevent or minimise the potential for land contamination.

Dr Howe said the proposed policy does not introduce any additional requirements for developers and landowners.

“When Council carries out its planning function, the history of land use needs to be considered as an indicator of potential contamination,” Dr Howe said.

“This policy aims to provide clarity on how existing regulatory requirements will be applied to all land within shire.”
