To keep our community up to date with key Council decisions, outcomes and plans; here is a snapshot summary from Council’s Wednesday 5 June Council Meeting.           

Planning and Development Local Law Review

Council received the proposed Community Local Law 2024. 

Council authorised commencement of the statutory process for the making of the proposed Community Local Law 2024 in accordance with the Local Government Act 2020, by giving public notice in a local newspaper and on Council's website of its intention to make Community Local Law 2024, stating the objectives and intended effect of the proposed local law, and that a copy of the proposed local law is available for inspection at the Baw Baw Shire's (Shire's) Service Centres and on the Shire's website, and the community engagement process that applies in respect of the making of the local law.

Council will undertake community consultation on the draft Community Local Law 2024, between 7 June and 5 July 2024.

Community Infrastructure  Sports Pavilion Design and Development Policy and Fair Access Policy

Council adopted the Sports Pavilion Design and Development Policy and the Fair Access Policy.

Closed Trafalgar Landfill - Options for Managing Onsite Leachate

Council endorse officers to commence the process to seek approval from Environmental Protection Authority (EPA) to discharge to environment, including community consultation.

Neerim South Recreation Reserve Pavilion Options

Council moved to;

Endorse the proposed Master Plan Option 2 as the preferred design option for the Neerim South Recreation Reserve;

Progress the pavilion as outlined in Option 2 to detailed design; and,

Produce a staging plan and detailed cost plan to guide future construction sequencing of the various elements of the Master Plan Option 2.

Economic Development, Grants and Advocacy Plan Victoria - Baw Baw Shire Council Submission

Council moved to;

Endorse Council's submission Victorian Government's consultation for Plan Victoria; and,

Lodge Council's submission to the Victorian Government by 30 June 2024.

Strategy and Organisational Performance

Response to General Business Motion from 17 April Council Meeting and Petition regarding the proposed closure of Erica Preschool

Council noted the report received in response to the General Business Motion of 17 April and continue to support the Erica community to advocate for the retention of Erica Kindergarten service.

Council will advise the lead petitioner of the petition response.

2025 Community Satisfaction Survey Question Design

Council moved an alternate motion to;

Include 6 additional survey questions to its 2025 Community Satisfaction Survey, specifically in relation to Council’s performance and the importance of the service to the community for the following services areas: a. General town planning policy, b. Planning and building permits, c. Unsealed road maintenance; and, Endorse the following questions for inclusion in Council’s 2025 Community Satisfaction Survey: a. How important should general town planning policy be as a responsibility for Baw Baw Shire Council? b. How important should planning and building permits be as a responsibility for Baw Baw Shire Council? c. How important should maintenance of unsealed roads in your area be as a responsibility for Baw Baw Shire Council? d. How has Baw Baw Shire Council performed on general town planning policy over the last 12 months? e. How has Baw Baw Shire Council performed on planning and building permits over the last 12 months? f. How has Baw Baw Shire Council performed on maintenance of unsealed roads in your area over the last 12 months?; and, Explore community sentiment for performance measures during the upcoming engagement associated with the development of the new Council Plan, following Council elections. 

2023/24 Community Grants Program - Community Projects Round 2

Council noted the outcomes from the 2023/24 Community Grants Community Projects Round 2.

Q3 2023/24 Combined Performance Report

Council noted;

1. The Quarterly Performance Report for Quarter 3 of 2023/24;

2. The Financial Report for Quarter 3 of 2023/24; and,

3. The Capital Works Program Report for Quarter 3 of 2023/24.

Governance and Information Services Delegation Review and Update

In the exercise of the power conferred by section 11(1)(b) of the Local Government Act 2020,  Council resolves that:

a) There be delegated to the person holding the position, or acting in or performing the duties, of Chief Executive Officer the powers, duties and functions set out in the attached Instrument of Delegation to the Chief Executive Officer, subject to the conditions and limitations specified in that Instrument; b) The instrument comes into force immediately upon this resolution being made; c) On the coming into force of the instrument all previous delegations to the Chief Executive Officer are revoked; and d) The duties and functions set out in the instrument must be performed, and the powers set out in the instruments must be executed, in accordance with any guidelines or policies of Council that it may from time to time adopt.

In the exercise of the powers conferred by the legislation referred to in the instrument of delegation in Attachment 2, resolves that: a) There be delegated to the members of Council staff holding, acting in or performing the duties of the offices or positions referred to in the attached Instrument of Delegation to members of Council staff, the powers, duties and functions set out in that instrument, subject to the conditions and limitations specified in that Instrument; b) The instrument comes into force immediately upon this resolution being made and is to be signed by the Council’s Chief Executive Officer and the Mayor; c) On the coming into force of the instrument all previous delegations to members of Council staff (other than the Chief Executive Officer) are revoked; and d) The duties and functions set out in the instrument must be performed, and the powers set out in the instruments must be executed, in accordance with any guidelines or policies of Council that it may from time to time adopt.

Notice of Motion

Council tabled a notice of motion requesting a report into the feasibility of Roads, Drainage and Footpath Advisory Committee; a Gender Equity Advisory Committee and options for the purpose and continuation of the Access and Inclusion Advisory Committee.

A report will be brought back to Council no later than the 7 August Council Meeting.

Baw Baw Shire Council Council Meetings are open to the public and are held at the West Gippsland Arts Centre.

Council Meetings will be held on the first Wednesday of the month and commence at 1.00pm for a 6 month trial period.

Following the conclusion of the trial on 30 June 2024, Council will either revert back to twice-monthly Council Meetings at 5.30pm or resolve to continue once-monthly Council Meetings.

All Council meetings will be live-streamed, and archived recordings will be available on the Council website for viewing.

The agenda for the next meeting will be available online the Friday prior to the meeting.
